**[0:00]** This just in, there's been an attack. There's been an attack downtown. We're not sure what's going on here. Hold on. Reports are coming in. They say the attacker was a brown Muslim man who said something in Arabic before he attacked.

**[0:17]** And it seems like they're saying that this could be an act of terrorism. Wait a second. Actually, no. It seems actually that's not true. That the attacker is actually white, a male in his mid-40s, and he was beloved by his community and he was psychologically disturbed.

**[0:34]** This type of framing should be familiar to you if you've paid any attention to the news over the past 20 or so years. And it's very, very frustrating when we see that violence is treated differently solely based off of the identity of the attacker or the person who's carrying it out.

**[0:49]** Now, to be clear, we're completely against violence of this type, but many of us feel that something profoundly unfair is going on. All of a sudden, you've got somebody who, because of either their color or their ethnic origin or their national origin, their religion even,

**[1:04]** they could be facing multiple life sentences. They're somebody who is supposedly motivated by hatred and religious violence and these sorts of things on one hand. And then if the situation changes and it's just a normal person, somebody with a lighter complexion who's not a Muslim,

**[1:22]** who doesn't meet the scary person that they sell to you on the news, then this person, maybe they'll get a slap on the wrist and get released on good behavior, if at all. If they're even convicted in the first place. Certainly, they won't be charged with terrorism.

**[1:37]** And that's what we're here to talk about today. We're here to talk about terrorism and anti-terror law and the profoundly unfair nature of anti-terror law. Now, it's not exactly what you think. You might have suspected and you might have sensed just due to experience and osmosis that these laws are not fair.

**[1:56]** They target Muslims. They target brown people and black people. They target some populations and other populations. It's almost as if categorically they're not possible of committing terrorism. But the story of anti-terror law, at least in the United States, is a lot darker than you think.

**[2:12]** And the dark secret hiding behind anti-terror law in the United States is that it was made this way by design. It actually was intentionally formulated not to protect average American citizens, but to protect Israel.

**[2:27]** The first mention of terrorism in U.S. federal law goes way back to 1969 in the Foreign Assistance Act of that year. Now, you should be thinking of this question in your mind. Why so early? People weren't talking about terrorism.

**[2:42]** Terrorism was not a thing that was front and center, front page news at that time. Well, there's a very, very important reason why it showed up in our laws at that time. That there is a connection to Israel-Palestine. No American president will let Israel go down the tube.

**[2:59]** Democrat or Republican, it's not an issue. Now, I'm going to read to you a bit of history so that you understand where our anti-terror laws come from. And by the end of this video, you're going to understand exactly why these laws were not designed to protect Americans.

**[3:14]** They were actually designed to protect Israel. The first mention of this word terrorism, again, in the Foreign Assistance Act of 1969. What was the content of that law? The content of that law, Congress required the UNRWA, that is the UN body providing humanitarian assistance to Palestinian refugees.

**[3:33]** To ensure that no USA dollars would go, quote, to any refugee who is receiving military training. As a member of the so-called Palestinian Liberation Army. Or who has engaged in any act of terrorism.

**[3:48]** Now, I want you to think about this. How does this protect Americans? Where does this come from, this need to pass this law out of thin air? You're going to notice a pattern when we keep going. Let's go to the next decade in the 70s. In the 70s, anti-terror law starts to take shape a little bit.

**[4:05]** You get the first SST designation. That's called the State Sponsor of Terrorism. This is something that was developed in order to punish governments that were funding or allowing supposedly, quote-unquote, terrorist groups to operate. This was established by the International Security Assistance and Arms Export Control Act of 1976.

**[4:26]** In three years after that, the Export Administration Act of 1979. This took the power away from Congress and gave it to a three-letter agency. So, this is something that we'll notice as a trend. Now, the idea for this whole State Sponsor of Terrorism came from a certain Jacob Javits.

**[4:44]** Hopefully, I'm pronouncing that name correctly. He was a Republican pro-Israel senator from the state of New York. And the first targets of this legislation were Iraq, Libya, and southern Yemen. All of whom at the time were active supporters of the Palestinian liberation movement.

**[5:00]** So, again, we have to wonder who is this legislation protecting? Is it protecting American citizens or is it protecting Israel? Get to the 80s and we start to see these laws get more and more teeth. The Anti-Terrorism Act of 1987 was the first formal declaration of a single terrorist group.

**[5:19]** Now, guess who that is? Who is the first group that the United States announces or declares is a terrorist? It is none other than the PLO, the Palestinian Liberation Organization. And the text of that legislation is actually very, very interesting. Basically, one of the things that it identifies is that the PLO is committed to armed resistance.

**[5:38]** And so, this makes it a terrorist group. That's a problematic assumption that we're going to unpack a little bit later. Skip ahead to the 90s, okay? In the 90s, and notice this is all long, long, long before 9/11. You've got the Immigration Act of 1990. This established terrorism, quote-unquote, as a formal basis for exclusion and deportation.

**[5:57]** Any person that belonged to the PLO, it didn't matter if you were an officer, an official, a representative, a spokesperson. You didn't have to ever have touched a gun or been involved in any type of violence whatsoever. If you were just a simple member of the PLO, then that made you automatically considered to be engaging in terrorist activity.

**[6:16]** The 1990 Immigration Act also established this, or introduced rather, this notion of material support for terrorism. So, shifting from legislation that's targeting people who are committing violence, and you can have a discussion as to what is and what is not legitimate violence,

**[6:32]** to people who are fundraising, people who are doing charity work. And this is another trend that we're going to see more and more of. Two years later, the Anti-Terrorism Act of 1992, U.S. nationals are incentivized to sue terrorist groups and state supporters or state sponsors of terrorism for international acts of terrorism.

**[6:52]** Okay, that kind of makes sense, right? If someone, God forbid, U.S. national abroad, they are killed by a terrorist organization, then, okay. You would say, well, they wouldn't really have jurisdiction, so how would they be able to sue? But whatever, park that for a second.

**[7:07]** Listen to this. They're not just told that it's possible. They are incentivized by their being promised triple damages. That means like the amount of damages that they suffered in a normal court case, times that by three. They're promised that if they successfully prosecute this whatever, let's say the PLO, that they're going to be rewarded three times the damages,

**[7:29]** and all of their legal fees are going to be paid for if they are successful. Now, this act actually comes, there's a history to it. The reason that this act was pushed for was because there was insufficient ability to do this sort of thing previously.

**[7:44]** There was actually a court case by the Klinghoffer family against the PLO, and it was dismissed for lack of jurisdiction. Again, like how could the U.S. law, does it have jurisdiction over Israel and Palestine? Does it have, like by what jurisdiction are you able to sue a foreign government or a foreign non-state actor?

**[8:01]** It's kind of an interesting legal conundrum. So this particular piece of legislation, it releases the floodgates of pending legal and financial trouble against pro-Palestinian organizations. And I say pro-Palestinian organizations because at the time it was used against the PLO,

**[8:17]** but this legislation would be used later against more modern groups such as the Holy Land Foundation, such as the U.S. Campaign for Palestinian Rights, current lawsuits against Students for Justice in Palestine National and AMP, American Muslims for Palestine.

**[8:33]** This law is being used to open up these organizations, student organizations, charity organizations, to being sued by U.S. nationals. We'll assume, you know, U.S.-Israeli dual citizens or Zionists, that if anybody were to suffer anything in Palestine,

**[8:54]** let's say that there was a settler from New Jersey, quote-unquote settler from New Jersey and New York, and he goes over and he's trying to kick a Palestinian out of his home. Palestinian fights back and injures or kills that settler. That means that charity organizations in the United States could get sued for damages by that person's family.

**[9:15]** So you see again how these are attempting to create legal and financial mechanisms to punish something that has almost nothing to do with the security and the safety of American citizens. It has everything to do with the security of Israel and its interests and its agenda.

**[9:34]** 1995, the idea of material support gets more teeth. 1996, the Anti-Terrorism and Effective Death Penalty Act. This creates the category of the FTO, the Foreign Terrorist Organization. And crucially, the secretary of state is empowered to decide who is and who is not a terrorist organization.

**[9:53]** So as opposed to having a congressman or a congresswoman or somebody who's an elected official, that if you disagree with their decisions, that you can vote them out. Now it's in the secretary of state. And if you don't like it, there's nothing really you can do about it. The Treasury is also empowered to freeze the assets of any of those groups.

**[10:09]** If you're familiar with the Holy Land Foundation, we'll talk about them more in a second. Everything that they've ever raised is immediately frozen. And it also expanded material support to include not just if someone's giving money to someone else to go commit an act of violence,

**[10:24]** like that makes sense, but if someone is raising money for charity or for social services, if they want to provide wells in Gaza or West Bank or in Palestine, or if they want to build hospitals, that all of a sudden,

**[10:39]** raising money for these things can become considered material support for terrorism. As somebody, a lawyer that I know, put it to me, giving a cup of water, and if it falls into the hands, even if you didn't intend it, if it falls into the hands of a so-called a foreign terrorist organization decided by the secretary of state,

**[10:58]** then you are guilty of material support. Now, you might think, or a viewer might think, well, some of this makes sense, some of this is necessary to save American lives or protect American lives. I would like to push back on that. That is completely wrong.

**[11:13]** That all of this, the anti-terror law, even you could say all of it, by its structure, by its design, even potentially by its intent, is much more about protecting Israel and its agenda than it is protecting the United States or its citizens.

**[11:30]** And there is no better indicator of this than the case of the Holy Land Foundation. If you have not heard of the Holy Land Foundation, there is a book that you have to read by Miko Peled called Injustice, the Story of the Holy Land Foundation 5.

**[11:45]** We at the Holy Land Foundation were giving hope and providing the basic essentials to Palestinians, oil, rice, flour, and the occupation was providing them with death and destruction. And then we are turned criminal.

**[12:00]** And the Holy Land Foundation at one point was the largest Muslim charity in the United States. And the way that they were able to distribute it on the ground is that they worked with zakat committees. So, Palestine had local zakat committees, they would raise money in the U.S.,

**[12:15]** they would distribute it to the zakat committees, and the zakat committees would distribute it to the people on the ground. The United States sued the Holy Land Foundation and their entire case was saying that the zakat committees were controlled by Hamas.

**[12:30]** And Hamas became a FTO, a foreign terrorist organization, at that time. Or I should say by that time. Therefore, according to the government's case, the Holy Land Foundation was providing material support to Hamas

**[12:46]** by its charitable donations, raising money for wells and hospitals and other things like that. And it was falling into the hands of a terrorist organization and therefore they were guilty of material support. Now, crucially, the U.S. could not prove this in a court of law.

**[13:04]** They could not prove this link that Hamas was controlling the zakat committees and therefore it was falling into their hands. So, listen to what they did. They brought in an Israeli intelligence officer to testify anonymously as an expert witness that such a link existed.

**[13:21]** That this link between Hamas and the zakat committees existed. The second time ever that a federal prosecution allowed a foreign intelligence agent to testify anonymously under a pseudonym. But what was unique even about this trial was that they were allowed to do so not as any witness but as an expert witness.

**[13:41]** If you're familiar with the law, that this is different. An expert witness has different privileges that a normal witness doesn't have. So, the intelligence officer basically, again, completely anonymous, relied upon in a very disproportionate way, because they're, you know, an expert witness or considered by the court as an expert witness.

**[14:00]** They basically said, well, we seized some documents that you're not allowed to see. So, secret evidence that proves the link, that proves that Hamas was running these and controlling these zakat committees. And also they said that, oh, and here's some other documents that are supposedly from the PLO that prove that Hamas has control over the zakat committees.

**[14:20]** Those documents, by the way, were unauthored, they were unsigned, they didn't have any, you know, they could have been made up entirely. I'm going to read to you some quotes from some legal experts and some lawyers about what a travesty of justice this particular case against the Holy Land Foundation Five was.

**[14:35]** Quote, this is a Southern Methodist University assistant law professor, Jeffrey Kahn. He said, I've never heard of an expert witness being granted anonymity from the defense. The way you assess an expert's reliability and relevance is through his reputation, through his writings, through his professional experiences.

**[14:54]** How could you possibly impeach this witness, let alone test whether jurors should trust his opinion? Without knowing basic facts about who he really is. Another legal expert said the intelligence agent expert witness was basically unaccountable in what he said on at least two fronts.

**[15:10]** First, his identity is completely unknown and it's impossible to investigate an individual if you don't know their identity. Now, even if his identity were known and a subsequent investigation found that he lied or he perjured himself at trial because he's a foreign citizen,

**[15:27]** how is the United States going to have any ability to compel that person to come and to face any perjury related charges? So you see that there's multiple, multiple issues with the way that the Holy Land Foundation 5 case was done.

**[15:42]** Some of the five individuals that were charged are still in jail today. But the thing that I want you to pay attention to and to seriously ask yourself, who is this protecting? Is it protecting the United States of America and its citizens or is it protecting Israel?

**[15:59]** Who is this keeping safe? None of these laws, none of these maneuvers, none of these mechanisms of punishment and curtailing and trying to shut down charity work is doing anything to protect U.S. citizens or nationals.

**[16:14]** It is all to protect Israel. Now, what we find here is that Israel has weaponized this term terrorism. That's the point of this episode about this term terrorism, that if you look it up in the law, the definition of terrorism is extremely arbitrary. It is something that people don't use consistently.

**[16:32]** And that's where we come full circle to the beginning of the episode, that some people are capable of terrorism, apparently, and some people aren't. That if you are a non-state actor, every piece of violence that you do or every act of violence that you do is considered terrorism, potentially.

**[16:49]** Where if you're a state actor, even if you're the United States of America who drones weddings, that's not considered terrorism somehow because you're a state actor. So there's two rival ideas of terrorism. One is actual national security.

**[17:04]** Like there are people out there that want to commit violence. You can make an argument for that. That makes sense. And you would expect that anti-terror law would be focused on groups that actually try to engage in violence against the United States or its personnel, its property, whether at home or abroad.

**[17:21]** But that's not what anti-terror law actually does, and that's not how it actually works. In reality, anti-terror law is a tool of foreign policy, meaning it's geared at prosecuting and I'll say persecuting individuals connected to any organization and targeting foreign individuals and entities.

**[17:41]** How are you supposed to differentiate between a valid resistance movement and one that is actually putting U.S. lives in danger? That there's no mechanism, there's no nuance in the idea of what terrorism is at this point to differentiate between those two things.

**[17:57]** These are situations where foreign nations exploit this ambiguity. Like Israel has exploited it very efficiently that we are not able to differentiate what's a local issue. It's a foreign issue. There's a local resistance group. It doesn't have any international ambitions.

**[18:13]** It doesn't have any ambitions upon the United States or U.S. citizens. It's a local indigenous resistance movement against their occupiers. And yes, they use military. They use military force to what extent they can because they're being occupied and they have very, very little option to do otherwise.

**[18:31]** That's recognized within international law. So for the U.S. to have laws that punish that or allow nations, foreign nations like Israel to come in and to lobby in order to punish some resistance group across the world compared to somebody who actually wants to do violence to the United States, that's ridiculous.

**[18:53]** That these laws are both how they're designed and how they're used are more about protecting Israel than they are about protecting the United States or its personnel. And when there are situations what we found in the Holy Land Foundation 5 case is a perfect example of this.

**[19:08]** When there are situations where there is no violence, the people who are raising the Holy Land 5, they were raising money for charity. They were trying to build wells. They were trying to distribute food. They were trying to give medical aid. If there's no threat of violence, then what does this devolve into?

**[19:26]** Israel is against anybody who supports the Palestinian people. And it doesn't mean support in terms of money or arms or anything like that. If you just say, I don't like what Israel is doing to the Palestinian people, you're an enemy to the state.

**[19:42]** This devolves into relying on Islamophobia and innuendo. And I can say as somebody who's personally been targeted and remains targeted right now that this is all people have on. You can go through all of my talks, speeches, lectures, interviews. Never once have I ever called for violence against the United States of America.

**[20:00]** So what people will rely upon is they'll try to say, oh, well, this guy, look at him here with his beard and with his turban. And, oh, he believes in this and he believes in Shari'ah and he believes in that. This is all innuendo. If you're in the United States as a Muslim, you are in Dar al-'Ahd. You have a contractual, a social contract between you and the government that you have to abide by its laws.

**[20:20]** And you have to be an upstanding citizen and contribute to society. That's normal. But when there are situations in which you can't prove a link, OK, these people raising money for charity, they had nothing to do. They're far away from anything funding violence or being supporting violence of any type.

**[20:40]** The only thing that's going to fill the void is people trying to smear by saying that, oh, they're radical Muslims, they're radical Islamists or whatever. All right. So that's that's the lay of the land. And that's what we still have now. And what can we do about it? How are we going to be able to push back against this status quo?

**[20:57]** If you look at the history of anti-terror law in the United States, you notice some trends. Trend number one is the removal of accountability from who gets to make these decisions, both with the designation of SST, the state sponsor of terrorism and of FTO, the foreign terrorist organization.

**[21:14]** They began as being in the hands of Congress. Congress are elected officials that you can vote in and you can vote out. So there's an accountability mechanism there. But when they shifted to being taken over by the secretary of this and the secretary of that and this three letter agency and that three letter agency, all that accountability is gone.

**[21:32]** And so one thing that we can do is to try to push for these decisions to be made by elected representatives that we can actually have some sort of accountability over. The second trend that we notice is that many of these laws got tried out on immigrants with immigration law before they migrated to deal with citizens.

**[21:51]** And that's very concerning. And the average American citizen should know that you are not safe from being targeted by these laws. Israel doesn't care about your rights. Israel doesn't care about your constitution and your your freedoms that you have in the United States. They will trample on all of them if they are given the opportunity.

**[22:09]** And so you should be aware that if you see something happening to immigrants first, just like the material support clause or anything else, that it's very, very soon after that this is going to migrate to apply to citizens as well. So you have to ask, is that a standard that you're willing to live by?

**[22:26]** And the last and most important thing is that the government in its law must define clearly the difference between legitimate and illegitimate political violence by non-state actors, especially a country like the United States, who was founded upon revolution and rebellion from the British Empire,

**[22:46]** that it would be the highest level of hypocrisy to say that all violence, all political violence from non-state actors is illegitimate and is terrorism. OK, if we can recognize that that's not true, then you have to go out and define what is legitimate and what's not legitimate.

**[23:03]** If you don't, then you're going to always have this conflation of local and national resistance movements with actual international terrorist organizations that want to do harm to American citizens like everywhere they find them. Those two things are two very, very different things, and the law should reflect that.

**[23:22]** At the end of the day, the main point here is that Israel in particular has exploited the U.S. political and legal system to criminalize any resistance to its own supremacist occupation, and it has done so for a very, very long time. And as people of morality and as people of conscience, that we should fight back against that, and we should organize against that to make sure that they cannot exploit that thing any longer.
